Angry and the award for worst dealer goes to Mine in Ontario

Afternoon All
We purchased a new Melbourne Prestige in the spring of 2022 and several minor w/a issues were found. Our local dealer, in Bowmanville, Ontario (where we purchased the RV) made an appointment for us to bring the RV in the first week of December of 2022. They were also to replace a broken window above the cab. 3 1/2 months later, NO work had commenced. SIX months later and the RV is still not ready to be picked up. We have gone into the dealer, telephoned and emailed. We have told them that we would take back the RV in the condition that it is in and receive nothing but delaying tactics. We have contacted Jayco who does not seem to want to prompt the dealer We have written the President of Owasco, Bob Verway who has not even had the courtesy to respond to us.
We have missed our booked holidays in April and May and are currently at a loss as to how to proceed other than to take the dealer to court.
Any suggestions out there?

Signed
a very unhappy wannabe camper

First, I would be getting it off the dealers lot like tomorrow!

I don't know anything about the legal issues but it's time to deal with the Jayco motorized division directly IMO.

I have contacted jayco motorized and their suggestion is to send to another dealer. I was hoping that they would pressure their dealer to release it but it appears they are not If it's not somewhat ready by Thursday I told my husband we will just find it on one of their lots and drive off with it

I would go in and take it. Bet the batteries are dead, so come prepared. Broken window, I wonder how much water has leaked in????

My parents had an issue like that with a dealer 4-5 decades ago with a PU, that needed a new roof. The dealer had the parts, just never got around to doing the work. My dad, very PO'd after may conversations, finally drove into the lot, tipped the new roof off of the PU (exposed to the elements for who knows how long). Hooked up and drove home. The dealership kept telling him he could not take it. Dad was like, try me. Its not theft, as he was the owner.

Thanks so much for the reply; never thought of a flat battery. Will bring cables.

Sounds like us some dealers once you drive off the lot they never want to you again! For that reason, I will never buy new again. We bought an Eagle 30' fiver in 2015. Took about two years to get everything fixed. Still have that camper. Thanks

Hi, for the most part I agree with you, but being a motorized vehicle we really wanted the warranty.

If they give you a hassle and won’t let you take it call the local police and report it stolen!! No way you should have left it there that long. Just hope everything is still intact inside.

My husband and I try to be reasonably nice people in general It was a comedy of errors. Owasco neglected to work on it for the first 4 months and when given a pleasant shove by me brought someone in to replace the upper cab window. Window dropped and fell on the hood, Hood needed replaced and then re-painted S**t happens and we understand that but the rig should have been worked on months before and I cannot for the life of me see 2 months to replace hood and repaint it They promised it would be ready 2 weeks ago without fail and then possibly this week. They are no longer communicating with us. I no longer consider myself nice people

Besides the advice above, you might consider the services of an attorney (or is that a "barrister" in Canada?)

As Norty1 advised previously, deal with Jayco Motorized directly. IMHO you should set up an appointment to bring it to Middlebury. They built it and will be the most qualified to perform any repairs. Be prepared to leave it there and come back to get it when it is ready. Inconvenient? You bet it is. But your level of satisfaction will be far and away above what you will receive from any dealer. Good luck in whatever decision you make.

Lots of advice. Not being familiar with Canadian laws my thoughts are generic. I would hire a lawyer now. Just having counsel contacting the dealer may be enough. If you like, call the dealer and explain you're really busy and hired this attorney to help work through the issues.

If all it takes is a letter or phone call from the attorney it won't cost much more than $150 US. At the minimum a consultation with a consumer savvy attorney will explain all of your legal rights in the situation. You may have loads more leverage than we, or yourselves realize.

You should let it drop. I couldn't. I'd be twisting myself in knots plotting my next move.

Lmao. You are probably right. I am twisting in knots now. They have an open house tomorrow and I would love to go but would no doubt be taken away in a police car

I am the kind of person that would make up a 4x8 plywood sign and sit out front, on public land, during their open house. Maybe an anonymous tip to the local news. So what if the police show up. Play nice and worse they will do is get you to move on. The longer you can chat up the officers, the longer you get noticed. Don't make them do any extra paperwork.
210 people should have been a little more helpful. My 1/2 dozen warranty issues were adressed by my dealer without unhooking the trailer from my truck, on a Saturday no less. They have less than 2 dozen employees.
