Insurance totaled my camper

So Fourth of July I clipped the edge of my 2017 161 toy hauler it structurally sound. So I took it back the dealer they wanted $1700.00 to repair it. Insurance said it is only worth $20000.00 so they totaled it . They did not count any of the hundreds of dollars in up grades, tried taking it to another shop it was $4000 cheaper but they don’t care. I told them they will not get the pink.

Hold it......You posted that it repairs would cost "$1700.00", and insurance valued it at $20,000, and totlaed it. Did you mean to post $17,000 as the repair cost? (The numbers didn't add up.)

So insurance wants to write you a check for $20,000 and you are refusing the settlement. What's your next step? Hire an attorney? I'm really interested in how this turns out.

Have you read your policy? Basically if it does go to a judge to decide what's in your policy will prevail.

You should have the option to buy your trailer at the salvage price. So you would get a check for the net amount, basically the $20,000 minus salvage value. One possible issue down the road may be that you couldn't insure it for replacement since it may have a salvage title.

Finally, considering how difficult it is to build them right the first time, do you have confidence the lowest bidder repair shop can do the job? I would be grateful they totaled it and allowing me to go shopping.

If the cost to repair + salvage value (buy back) is significantly less than Ins. settlement it might be worth pursuing. The insurance valuation is btw. what it would cost to replace your toyhauler with a 2017 model, they can't assess upgrades. Not sure what you mean by "they won't get the pink", but if they write you a check the unit belongs to them.

I did a quick search on the used market for your unit. $19.000-$24,000. If the insurance company is willing to cut you a check for $20,000 I would take it. If you decide to “ buy it back” the value will decrease with a “salvaged title” when you try to sell it, and as mentioned you may have a difficult time getting insurance. I don’t think your upgrades come into play unless you notified the insurance company before the accident and they adjusted your coverage. No one wins when they total a vehicle/trailer. It’s a shame this happened to you but I think all you can do is minimize your loss. This is just not a good situation and I hope you get out of it with a minimum amount of financial pain.

I wouldn't even worry about insurance coverage if the salvage price is cheap enough. Any liability coverage is on the tow vehicle so that is not an issue.

I thought the tow vehicle liability only tranferred to the trailer when attached to the tow vehicle. Once detached there would have to be an RV specific liability policy.

So the reason I don’t want to give it up is it is the size I can haul with my Canyon and they don’t make this model my ATV fits and I don’t have the money to update another one, the closest one is on the other side of the US.

What is the time frame for the dealer to fix it if you would decided to buy it back from the insurance company?

I was thinking more about bodily damage liability insurance. And my frame of reference was from the years I spent full-timing, with no home or home owners insurance to fall back on.

That would be a seperate umbrella policy, which is what we had to buy under the same situation. I still have it today as extra coverage. It's from same company as my auto insurance.

So instead of $20,000 cash you'd be happy with $13,000 (low repair bid) and keeping your old one. I think you'll be happy when you ask for the salvage value. It can't be more than a couple thousand. Hopefully the repairs will be solid and not take too long.

BTW a quick search and it seems there are several available in California (assuming San Jose, CA) a 2016 for $16000 asking price, you could probably get that discounted. You could take the $4,000 for upgrades.

Here's an issue you might want to investigate. If you do keep the trailer and get the reapirs done, will you be able to insure it with anyone, being as it'll be on record as having been totalled by an insurance underwriter.

I agree. This site would be one of the last places I would go for insurance or legal problems. Get with your insurance agent. If not satisfied, go higher in the company. If no recourse there, look into a lawyer.
