Bait and switch

In February, I ordered a 2021[*]Northpoint 377RLmb and now the dealership says that we have to take a 2022 and pay the increase of price? What’s the point of my contract?. Open to any suggestions or feedback.

Different but the same. We have a yearly deal with a vendor. We just received word they are increasing the price of their meters by 11%. Basically any meter we have quoted to customers in the last 90 or so days we are goin to lose profit margin. Some of those margins were only 18% to begin with.

Price protections ended, from what I was told by a very reputable source, at the end of last year. Also if they are no longer building 2021's, 2022's would be all that is available. It's basically between you and the dealer. COVID has wreaked havoc on everything.

I seriously doubt you "have to" do anything, if they are not providing what is in the contract. You could always talk to a lawyer, if you don't want to do what they are trying to make you believe you have to do.

A contract is a piece of paper with words on it. But once signed it is a legal, binding agreement that you both will do some thing, ie exchange money for a product.
If you want to spend some money you could go to a lawyer to see if the contract is enforceable, ie, make them sell you a 22 for for the price agreed.

You and the dealer signed a purchase contract for a 2021 Northpoint. If they aren't being produced anymore due to the production delays, the contract may be null. I'd try to negotiate a fair price on the 22, but if that isn't possible, you can always look elsewhere to see what is available. Most inventories I've seen for vehicles and campers is pretty slim right now, though.

Nothing you can do about the 2022, but the price should remain the same.

That unit was ordered off old pricing.

This goes beyond the dealer, Jayco, even their suppliers. It sucks but the world economy was turned upside down by COVID. You can fight it but you will probably spend far more on a lawyer than than the price increase, and for that matter you are getting a model year newer unit than you thought. Do you want ulcers or do you want to go camping?

look at the contract or have someone who is a contract lawyer look at it.. but likely the contract was written that if a new model year comes out before you can get the one specified you are out of luck... remember they pay allot for lawyers to write the contract to their benefit... just like you would for yourself.. I would recommend in this climate is you specifically write in that if the year changes the price remains the same... if they don't sign then they don't have a deal...

it is certainly not a bait and switch, but if they said you had to pay 10% more for a 2021 and it was a different model then yes bait and switch ... this is more of a circumstances changed we can't get what you ordered...

it's tough for sure... but read the contract it will tell you what/if you have any grievance...

Unless there is something in the fine print the terms in the contract are final. If the price decreased do you think they would allow you to ask for a lower price.

Without the benefit of reading the contract, it's impossible to know. There are many different purposes that differently written contracts could serve in this context and it's impossible to know what yours says.

But, if your order was for a 2021 model and those are no longer made, it's unlikely that you'll have much recourse. You should be made whole, which would include a refund of any deposit you might have made ... and little else (you don't get compensated for time and aggravation).

Time to go shopping again, as terrible as that may sound.

I wouldn't call this bait and switch, though. That's a fraudulent action that involved advertising an item with the intention of substituting some lower quality or higher priced item after you respond to the ad. I don't see where that happened here.

I'd suggest looking at my threads for a lot of discussion on this.

Also, price protection drops were announced in May of 2021. Not that it will matter. You're likely going to be stuck just as I was (I ordered in Jan and still got hosed).

Picked up our '21 Pinnacle 36FBTS this past week. He had another identical one that had been specked out by a customer next to ours. We had a bad TV and he cannibalized that one to make ours good. He said the only difference was 10K more in price. He told me that when we bought ours, if I ordered a new one then it would have been at least that much more, but it would have ended up being a '22 and even more money
