Lemon law

Is there a lemon law on travel trailers in ny. I bought my trailer January 2018 it has spent 5 months of its life at the dealer and it's really getting frustrating.

Why don't you contact an attorney in your state?

Best advice after 16 plus years Law Enforcement:

If you think you might need a Attorney............... you need one

Usually Lemon Laws pertain to safety issues. The cheapest (and best) is check with a Consumer's Protection Agency in your State. A local Attorney that gives a "free fifteen minute" consultation is another possibility.

What kind of issues have you had?

We had furnace issues, hot water heater problems, the black water tank fell out of trailer, the siding on the entry side has to screws or bolts pushing it out creating the sideing to be wavy. We brought it to the dealer at the end of the season they called me last month to pick it up saying it was done and they never fixed anything. So now it's still there and I jeep getting excuses with its not done yet. Jayco said there is nothing they can do because they already paid them for the work trusting that the copleted it. Also has small issues like the radio not working, front door not closing properly, and the toilet being loose.

You don't need a lemon law, you need to hire an attorney to sue the dealership. If Jayco has paid them for completed warranty work and they never did the work, there's a case for fraud. A visit to the dealer from an attorney may get the ball rolling.

I checked the NY AG website and NY lemon laws only cover new/used motor vehicles and believe it or not wheelchairs.

Call the dealer and ask to speak to the owner. Calmly explain your situation and that you had found out from Jayco that they have already been paid for the work. Ask him what they are going to do next to make it right. If he's not interested or gives you the run-around, mention that you are considering hiring an attorney. He will do one of 2 things, either hang up on you, or fall over backward for you. Either way, push to get a full refund, or a different trailer.

That is not gonna happen.

Believe it or not, they are not required to fix it. Hopefully they do fix it!

If they have put warranty claims into Jayco, I sure hope they have "made attempts" to fix the issues. Just because Jayco pays claims doesn't mean the dealer cant open another one on the same issue. We have done this many times on intermittent items.

I am sure there is more to the story here.

If Jayco is willing to provide you documentation that they paid the dealer, then you will have recourse.

If Jayco deems this place as a "authorized warranty provider" they shouldn't be leaving you out to dry by saying it's not their problem because it is their problem. They paid the provider, and the provider never rendered any service. How did the provider issue an invoice to Jayco for work never done?

To me this seems like a serious matter that Jayco would want rectified.

Because dealers are buried and can't find help. Lemon laws usually require repeat repairs for the same problem.

If there is another Jayco Dealer reasonably close have them verify the problems that you still have after being to your original Dealer. Present that to Jayco to show that the 1st Dealer charged Jayco for work that wasn't done or done in a inferior way.

To OP: If things are exactly as you said, you need to 1) retain a lawyer, 2) Have lawyer send a letter requesting the information documenting when they paid the dealer.

With that in hand, your lawyer can proceed against the dealer and/or Jayco.

Um, not true. They do have to fix it. Laws vary by state but consumers have specific rights. Just because they refuse doesn't mean they are not obligated. Now, getting them to follow through is another thing. That's why a lawyer sometimes has to be brought in.
