The loose pivot bolt comment gave me a thought...
There is a possibility that the owner left the bars on, but owner didn't position the bars that way and they didn't pivot by themselves...

Maybe a 'prankster' moved them to that position?

Well, if that is the case, he sure didn't learn a lesson. How hard would it be to walk by, unpin the bars, and walk off with them?

I'm going with the "lazy" theory.

Now there you go destroying a perfectly good theory.

Only reasonable explanation, looking for ground water without the wooden stick otherwise looking to get sued by someone

If I remember correctly there was a WDH where the bars stayed attached, but were pinned close to the vehicle when not in use. I've seen it more than once.

I leave my bars on all the time when I'm camping. I have the E4 hitch, looks similar to that, but my bars are parallel to my bumper and stick out no further than my hitch. Call me what you want, but what difference does it make if I leave them on my truck or leave them at the campsite?

Trailer ball still sticks out further, so it's not an more of an obstruction than that.

This guy, with one bar sticking our perpendicular... that's another story.

I also have the E4 hitch. I take mine off and put into the bed of my truck. I don't want to fold them into the bumper because they are too difficult, or I don't want, to move them into the bumper. I keep mine really tight.

Although I cant believe someone would leave them like that! I like some of the theories though!

We found Little Bighorn very interesting too! I learned a lot for sure, and the movie reenactment was excellent!

When we pulled a "tow behind" we had the same type of Equal-I-zer bars. They are great! Left ours on all the time, but had the pivot nuts tight enough they didn't swing out easily. I used them as steps to get up in the bed of our Chevy pickup. I also put reflective tape on them to make it all legal.

The original question was "What would you do?" I'd be a good neighbor and push the bar back in place. If I saw the owner I'd tell him what I did and tell him he needs to tighten the axis nut. As far as what else I would do is get the same type of bars, because they are the best. Your opinion may differ.

Where is here?... I think I went 10 years with a hitch on the back never removed it ever maybe 50 % towing. That thing is too heavy to pop in And out daily. Fyi no bars.

I think those bars are bolted on and not easy to remove seen at camp ground a bunch never in public like this.

I leave my equalizer on my 3500. I don't take it off, ever. it has a class V hitch, so You have to sleve it for class III. so it's a pain to put the hitch on. You hit me in the azz, you are too close!

I don't leave the bars in tho....

Lots of people leave stuff in their hitch because (1) they're too lazy to remove and store it, and/or (2) it provides an important collision protection function. This case is just a more elaborate take on that theme. There are also cases where the drawbar has been inserted in the hitch for too long and has rusted in place and is very difficult to remove.
